GhostView is in early access. These terms are published in draft; the registering legal entity and governing jurisdiction will be confirmed, and the document counsel-reviewed, before general availability. Questions: rob@cartooli.com.

These Terms govern your access to and use of GhostView (the “Service”), operated by the GhostView team. By creating an account or installing the embed, you agree to these Terms. If you are accepting on behalf of an organization, you represent that you have authority to bind it.

1. The Service

GhostView provides session recording, analytics, and AI synthesis for websites where the customer installs the GhostView embed script. We may update, improve, or change features over time.

2. Acceptable use

You agree not to use the Service to: violate any law; deploy the embed on sites you do not own or control; capture data from children where prohibited; record special-category personal data (health, financial, biometric, etc.) without a lawful basis; attempt to de-anonymize visitors; or interfere with the Service’s security or operation.

3. Your privacy and consent obligations

You are the data controller for any personal data captured through your installation of the embed. You are solely responsible for: posting your own privacy notice; obtaining any consent (including cookie/tracking consent) required by the GDPR, CCPA/CPRA, ePrivacy rules, or other applicable law before the embed runs; and configuring field masking so sensitive inputs are not recorded. GhostView provides the tooling; the lawful deployment of it is your responsibility.

4. Accounts

You are responsible for safeguarding your account credentials and API keys and for all activity under your account. Notify us promptly of any unauthorized use.

5. Intellectual property

The Service, including its software, design, and trademarks, is owned by GhostView and its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service. You retain ownership of the session data you collect, and may export it at any time.

6. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

7. Limitation of liability

To the maximum extent permitted by law, GhostView will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits. Our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amounts you paid us in the 12 months before the claim or US$100.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service. On termination, your right to use the Service ends and your data is deleted in accordance with the Privacy Policy.

9. Governing law

These Terms are governed by the laws of the jurisdiction in which the operating entity is registered — to be confirmed before general availability — and disputes are subject to the exclusive jurisdiction of its courts, without regard to conflict-of-laws rules.

10. Changes to these Terms

We may revise these Terms from time to time. Material changes will be reflected by the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance.
